1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Scribage ("Company," "we," "us," or "our"), concerning your access to and use of the scribage.sbs website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site") and our AI-powered image-to-text generation services (the "Services"). You agree that by accessing the Site and/or Services, you have read, understood, and agreed to be bound by all of these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

2. Description of Service

Scribage provides users with the ability to upload images and generate various types of text content (such as stories, recipes, poems, blog posts, etc.) based on those images using artificial intelligence. The Service also provides analytical metrics related to the generated content, including SEO and content quality scores. These metrics are provided for informational purposes only and do not constitute professional advice.

3. User Accounts

To access certain features of the Service, you may be required to register for an account. When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. User Content & Generated Content

You retain ownership of any intellectual property rights that you hold in the images you upload ("User Input"). However, by uploading User Input to the Service, you grant Scribage a worldwide, non-exclusive, royalty-free, sublicensable license to use, process, transmit, and temporarily store your User Input solely for the purpose of providing and improving the Service.

The text content generated by the Service ("Generated Content") is produced by artificial intelligence. While you may use the Generated Content for various purposes, ownership rights in AI-generated works can be complex and vary by jurisdiction. Scribage does not claim ownership of the Generated Content itself but retains ownership of the underlying Service and AI models. You are responsible for ensuring your use of Generated Content complies with applicable laws and does not infringe on third-party rights. We make no representations or warranties regarding the accuracy, uniqueness, or suitability of the Generated Content for any particular purpose.

We do not store your uploaded images or the Generated Content permanently in our primary databases beyond what is necessary for providing the service during your session and for potential short-term caching or aggregated, anonymized analytics.

5. Prohibited Uses

You may use the Site and Services only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

• In any way that violates any applicable national or international law or regulation.
• To exploit, harm, or attempt to exploit or harm minors in any way.
• To upload or generate content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable, or that infringes on any third party's intellectual property rights or other rights.
• To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site.
• To engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools, except as may be the result of standard search engine or Internet browser usage.
• To impersonate or attempt to impersonate Scribage, a Scribage employee, another user, or any other person or entity.
• To reverse engineer, decompile, or otherwise attempt to discover the source code or underlying algorithms of the Services.

6. Service Availability and Modifications

We reserve the right to withdraw or amend our Service, and any features or materials we provide via the Service, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Service is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Service, or the entire Service, to users, including registered users. We may update the content and features of the Service from time to time, but its content is not necessarily complete or up-to-date.

FURTHER, SCRIBAGE DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS CONCERNING THE ACCURACY, LIKELY RESULTS, UNIQUENESS, OR RELIABILITY OF THE USE OF THE GENERATED CONTENT OR SERVICES OR OTHERWISE RELATING TO SUCH MATERIALS OR ON ANY SITES LINKED TO THIS SITE. THE GENERATED CONTENT IS PRODUCED BY AI AND MAY CONTAIN INACCURACIES, ERRORS, OR BIASES; YOU USE IT AT YOUR OWN RISK. THE ANALYTICAL METRICS PROVIDED ARE ESTIMATES AND FOR INFORMATIONAL PURPOSES ONLY.

8. Limitation of Liability
